Terms of Service

These Terms govern your access to and use of Kenya Technicians, operated by Brian Egesah, trading as QuickBuiild Africa (Business Registration No. BN-B8S6YVDZ, registered under the Registration of Business Names Act) ("we", "us", "the Platform"). By creating an account you agree to be bound by them.

This is a summary of a legal document, not the whole story. Please read the full sections below before agreeing — especially Payments, Wallet & Escrow and Bookings, Cancellations & No-Shows, which affect your money directly.

1. Acceptance of Terms

By registering for an account, checking the "I agree to the Terms of Service" box, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are registering on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

If you do not agree, do not create an account or use the Platform.

2. Definitions

3. Eligibility & Registration

You must be at least 18 years old and capable of entering into a binding contract under the laws of Kenya to register an account. You agree to provide accurate, current, and complete information during registration, and to keep it up to date.

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@technician.co.ke if you suspect unauthorized access.

One phone number or email address may only be associated with a single account. Attempting to register duplicate accounts to circumvent suspension, fees, or verification is a violation of these Terms.

4. Account Types

The Platform supports two Provider account types, and the features, plans, and obligations available to each may differ:

Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between the Platform and any Provider or Client. Providers are independent contractors responsible for their own tax, licensing, and regulatory obligations.

5. Identity Verification

Before a Provider account can go live, we require identity verification ("KYC"): a government-issued identification document (National ID, Passport, Business Registration Certificate, or KRA PIN Certificate, as applicable) and a selfie photograph. You consent to us processing these documents, including through automated or manual review, to confirm your identity and eligibility to provide services.

An account remains in a "pending review" state until verification is approved. We may reject a submission that is unclear, inconsistent, or fails our checks, and may request resubmission. We may also periodically re-verify accounts or request updated documents.

Providing false, altered, or someone else's identification documents is grounds for immediate account termination and may be reported to the relevant authorities.

6. Platform Services

Depending on which modules are enabled for an account, the Platform may offer: job postings and applications, longer-form projects, scheduled bookings, and a public marketplace listing. We do not guarantee that any specific feature will be available to every account, and we may enable, disable, or modify modules at our discretion.

The Platform is a venue that connects Clients and Providers. We do not perform the underlying technical work ourselves, do not employ Providers (unless separately and explicitly stated), and are not a party to the service agreement formed between a Client and a Provider for a specific Job, Project, or Booking.

7. Bookings, Cancellations & No-Shows

Each Provider sets, or is assigned, a cancellation policy covering: the notice period during which a Client may cancel free of charge, a late-cancellation fee, and a no-show fee. These are shown to a Client before they confirm a Booking and are enforced automatically at the time of cancellation or a missed appointment.

Repeated late cancellations or no-shows by either a Client or a Provider may result in a warning, temporary restriction, or account suspension.

8. Payments, Wallet & Escrow

Where enabled for an account, the Platform provides a wallet for holding funds and, for certain transaction types, an escrow mechanism that holds a Client's payment until agreed conditions (such as job completion or a set release date) are met before releasing it to the Provider.

Deposits and withdrawals may be subject to daily and monthly limits configured on your account, and are processed via the payment methods enabled for your account, which may include M-Pesa (via the Safaricom Daraja API) and other methods we support from time to time.

You are responsible for the accuracy of any payment details you provide. We are not liable for funds sent to an incorrect phone number, account, or reference supplied by you. Wallet balances are not bank deposits and are not insured; they represent funds held on your behalf within the Platform pending withdrawal or use.

We may reverse, hold, or investigate a transaction we reasonably believe to be fraudulent, erroneous, or in breach of these Terms, and will log such actions in accordance with our internal audit procedures.

9. Subscription Plans & Billing

Business Accounts and Freelancer Accounts select a subscription plan at registration and may change it later from account settings. Some plans include a free trial period; unless you cancel before the trial ends, your plan converts to a paid subscription billed at the price and cycle shown at the time you selected it.

Fees are non-refundable except where required by law or expressly stated otherwise. We may change plan pricing prospectively, with notice, for future billing cycles.

10. Invoicing & Fees

Invoices generated through the Platform may include a grace period before they are considered overdue, after which a late fee may apply as configured on your account's invoicing settings. Where auto-deduction is enabled, we may deduct amounts owed directly from your wallet balance according to the deduction priority configured for your account.

11. Communications

By registering, you consent to receive transactional communications related to your account — including booking confirmations, payment notices, KYC status updates, and security alerts — by SMS (including via Africa's Talking or similar gateways), email, and in-app notification. You may opt out of non-essential marketing communications at any time from your notification preferences; you may not opt out of essential transactional and security notices while your account remains active.

12. User Conduct

You agree not to:

We may investigate suspected violations and take any action we deem appropriate, including warnings, suspension, or termination.

13. Content & Intellectual Property

The Platform's software, design, logos, and branding are owned by us or our licensors and may not be copied, modified, or used without written permission. You retain ownership of content you upload (profile photos, business descriptions, portfolio images), but grant us a non-exclusive, royalty-free license to display it on the Platform for the purpose of operating the service.

14. Disputes Between Users

We may, but are not obligated to, help mediate a dispute between a Client and a Provider regarding a specific Job, Project, or Booking. Any decision we make in connection with such mediation (including releasing or withholding escrowed funds) is made in our reasonable discretion based on the information available to us, and does not constitute legal advice or a binding arbitration.

15. Suspension & Termination

We may suspend or terminate an account, with or without notice, for breach of these Terms, suspected fraud, failed or expired identity verification, non-payment, or at our reasonable discretion to protect the Platform or its users. You may close your own account at any time by contacting support; outstanding wallet balances will be handled in accordance with our standard withdrawal process.

16. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available". We do not guarantee that the Platform will be uninterrupted, error-free, or that any Provider's work will meet your expectations — we are a venue connecting Clients and Providers, not the provider of the underlying technical services.

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Platform, or from the acts or omissions of another user. Our total liability for any claim arising from these Terms is limited to the fees you paid us in the three (3) months preceding the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your use of the Platform, or a Job, Project, or Booking you entered into with another user.

18. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Eldoret, Kenya.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email, SMS, or an in-app notice before they take effect. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms.

20. Contact Us

Questions about these Terms can be sent to support@technician.co.ke or by phone/WhatsApp to +254 700 000 000.
